COMMENTARY:

We don’t have all the details about this crash, but police have said that alcohol was a factor in this crash. Since the driver has not been arrested, the person who had been drinking may have been the pedestrian. When something tragic like this happens, the loved ones left behind often feel hopeless over the tragic loss and about recovering financially for a crash when their loved one may have been partially responsible. There may be others who share responsibility for this loss such as a bar or restaurant where he may have been drinking prior to the incident. In Texas, certain family members can file a lawsuit against an alcohol provider such as a bar or restaurant who may have over-served a patron. A thorough investigation is necessary to get all the facts so that the family can gain closure and decide how to move forward. Reaching out to an attorney experienced in handling this type of claim is imperative so that they can preserve available evidence.
