COMMENTARY:
Reports have not said exactly what led to the Manslaughter charges in this crash other than the driver losing control of his truck. Those are pretty serious charges so it would seem that investigators believe that there is enough evidence to show the driver was negligent in his actions, causing the crash. Hopefully, a thorough investigation will be conducted by the police. In the meantime, a mother of six and another driver have both lost their lives in this crash and the families are left to handle final affairs and grieve. It’s hard to think about an insurance claim at such a difficult time, but when multiple claims against a policy are possible, it is important to know coverage limits and act quickly. Since commercial insurance policies usually have their own attorneys, going through this claims process alone can be detrimental to obtaining the most equitable settlement. Reaching out to an attorney experienced in handling these types of cases might prove critical to your success and can provide you with the support you need. The course and scope of employment of the truck driver and the driver safety training and supervision are likely to be very important issues in the case.
